Public Hearing of Amendments to the Land Use Regulations and Consideration and Approval of Resolution 2022-_____ Amending the Archuleta County Land Use Regulations

The proposed amendments to Section 3 - Zoning, Section 5 - Development Standards, and Section 11 - Definitions of the Archuleta County Land Use Regulations provide a new Use Type of Event Center for commercial events such as private meetings, reunions, and weddings.

A.

Public Hearing on Revocation of Liquor License for Keep Twoo LLC

This is a public hearing to determine whether to revoke the Hotel and Restaurant liquor license for Keep Twoo LLC dba Coyote Moon Bar & Grill.  The building was recently sold and the lease held by the licensee has been terminated by the buyer.  In addition, the licensee has neglected to comply with multiple requests by the Pagosa Fire Protection District for scheduled fire inspections and the Fire Inspector has noted multiple violations of the Fire Code.  The new buyer intends to apply for a new liquor license and will reopen Coyote Moon once the fire and building code violations are cured and a liquor license is obtained.

Consideration and Approval of a Hotel and Restaurant Liquor License Renewal for Chimney Rock Restaurant and Tavern LLC

This is a renewal of a Hotel and Restaurant liquor license for Chimney Rock Restaurant and Tavern LLC dba Chimney Rock Restaurant and Tavern located at 18710 W. Hwy. 160 in Bayfield, Colorado.  This renewal includes no changes.  The application is complete and the proper fees have been paid.  The Sheriff's Office and the County Building Department have completed their inspections and found no issues.  The financial impact to the County is the fees paid per the County Fee Schedule and staff recommends approval of this liquor license renewal.  Responsible Staff:  Mary Helminski, Liquor Licensing Agent.

Consideration and Approval of First Amendment to Public Contract for Services

This Amendment revises Exhibit B to the Public Contract for Services signed on July 1, 2022 with Healthy Archuleta, Inc.  The change is due to the State providing different calculations in the amount due to the Contractor from the Colorado Dept. of Public Health and Environment Health Disparities Community Grant Program.

 

NEW BUSINESS

A.

Consideration of Resolution 2022-____ Adopting the Archuleta County Policy and Procedures Regarding Secure Transportation Services

House Bill 21-1085 created a regulatory and service system to provide public or private secure transportation services to individuals experiencing a behavioral health crisis.  Every Colorado county is required to implement a Secure Transportation Services program, including issuing licenses and vehicle permits for such transports, complaint processing, and enforcement of the proposed rules.  Beginning January 1, 2023, any entity (with some exemptions) that provides secure transportation must apply for and receive a license issued by the county.  Each service must also apply for and receive a permit for each vehicle it uses to provide secure transportation services.  This resolution provides this policy.

Consideration and Selection of Vendor for Payroll and Human Resources Services

The Finance and Human Resources offices have consulted with three vendors who offer payroll and HR services that would better serve the departments than the current software program used.  Staff recommends contracting with Rippling at a cost of $44,369.00 annually.  There would be an additional $10,000 cost the first year for implementation of the service.

Consideration of Resolution 2022-___ Related to the Use of Excessive Force and Other Documents Needed for HomesFund Application for Community Development Block Grant Funding

HomesFund, in cooperation with the City of Durango, is applying for funding from the Dept. of Local Affairs Division of Housing's Community Development Block Grant.  This grant provides mortgage/down payment assistance to eligible low and moderate income homebuyers in Southwest Colorado.  The application requires several documents to be signed by Archuleta County, including a resolution, a letter of support, an intergovernmental agreement and others.

Consideration of Resolution 2022-____ Approving the Archuleta County Fee Schedule

Pursuant to C.R.S. 30-11-108, the Board of County Commissioners are charged with establishing fees charged for county services.  This resolution updates certain fees.  Suggested amendments or additions to the current fee schedule are highlighted in yellow to ensure transparency in how the county represents changing fees.

Consideration of Joint Resolution 2022-____ with La Plata County to Dissolve the District Public Health Agency Known as San Juan Basin Public Health

Pursuant to C.R.S. 25-1-513(2), a county has the power to withdraw from a district public health agency by adopting a resolution and providing at least one year's notice.  This joint resolution with La Plata County, if adopted by the Board of County Commissioners of Archuleta County and La Plata, will provide notice to San Juan Basin Public Health that both counties intend to withdraw from the district public health agency effective December 31, 2023

Consideration and Approval of an Intergovernmental Agreement with La Plata County and San Juan Basin Public Health for the Orderly Dissolution of San Juan Basin Public Health

This Intergovernmental Agreement with La Plata County and San Juan Basin Public Health sets forth how the various assets of San Juan Basin Public Health will be accounted for and distributed between Archuleta County and La Plata County, and how the affairs of San Juan Basin Public Health will be orderly wrapped up by a receiver upon its dissolution.
