A.

Consideration of Resolution 2018-___ Setting Forth Ballot Language and Establishing Bonding Authority for Archuleta County

Provided for your consideration is a Resolution setting forth the necessary ballot language required for a taxing increase request to go before the electorate of Archuleta County.  State Statute requires that all ballot language be delivered to the County Clerk by a date certain in order for a ballot to be certified.  For the calendar year 2018, that date is September 5th.  This proposed action by the Board of County Commissioners satisfies that requirement.  The ballot question provided herein shall be the ballot question submitted to the voters for their consideration at the November 6th Coordinated Election.

Two ballot questions are provided for the Commissioners' review and approval, one marked LONG and the other marked SHORT.  

The intent of the request is to seek voter authorization to raise taxes for Justice System capital improvements.

Consideration of Resolution 2018-____ - Declaration of Intent by the Board of County Commissioners to Reimburse the County with Bond Proceeds

A Reimbursement Resolution is one of the first steps that the County will take regarding an anticipated ballot question as it relates to bond issuance for new criminal justice facilities.  The intent of this Resolution is to establish parameters by which the County can be reimbursed for all or a portion of capital expenditures incurred or to incurred on the County‚Äôs behalf.  One of the statutory requirements of the Resolution is the inclusion of a "not to exceed" reimbursement amount.  The amount shown in the proposed Resolution is a not to exceed amount, and is there for no other purpose but to meet that requirement. Definitive amounts will be in the actual ballot question.

Abatement Hearing

Petition for Abatement or Refund of Taxes. Parcel Number 5699-201-27-001, Account # R010460 the owners being Southwest Colorado Mental Health Center Inc. The property being located at 52 Village Dr. This is an Abatement for tax year 2017 in the amount of $6,310.40. The petitioners applied to the Division of Property Taxation for an exempt classification and were granted this on July 25, 2018. The $6,310.40 is over my $2,500 approval limit.

Gary Devloo of Pagosa Springs and David Bouquet of Spring, TX, have applied for final plat approval of the Pagosa in the Pines Amendment 2018-01, a replat and easement vacation of Lots 27, 28, 29, 31 & 32, Block 4 of Pagosa in the Pines subdivision, creating Lots 27Z (601 Handicap Ave) and 31Z (152 Carlee Pl) (PLN18-128). The property is owned by the Gary H. Devloo Living Trust and David Bouquet, and is zoned Planned Unit Development (PUD) R-1-90. The Archuleta County Planning Commission held a public meeting on August 22, 2018, and recommended approval.

This is a renewal of a Hotel and Restaurant Liquor License for Marconi's Italian Restaurant LLC DBA Marconi's located at 117 Navajo Trail Dr. Suite D, Pagosa Springs, Colorado. This renewal includes Report of changes to trade name from Marcos of Colorado LLC to Marconi's Italian Restaurant LLC. This application is complete and the proper fees have been submitted. The Sheriff's Office has completed their background check and the Building Department has inspected the premises for changes.

Letter of Support for Banded Peak Ranch Conservation Easement Project

This is a Letter of Support for the Banded Peak Ranch Conservation Easement Project.

Acceptance of CDOT Division of Transit and Rail Admin and Operating Award

The Colorado Department of Transportation (CDOT) Division of Transit and Rail has accepted the County's application for 2019 funding for the operation of Mountain Express Transportation.  The total project award is $160,630 which is broken out by the State award of $93,440 and the County contribution of $67,190.

Consideration and Direction to Proceed with Amending the Ordinance for the Regulation and Licensing of Marijuana Business Establishments

This is a request to direct Staff to draft an Amendment to Ordinance 13-2015 for the purposes of making changes to the Prohibited Locations surrounding retail and medical marijuana facilities in Archuleta County, in particular to reduce buffers from a Public Park or Church.

Consideration of Acceptance of the Emergency Management Performance Grant for 2018

For 2018, the Division of Homeland Security and Emergency Management has provided Archuleta County with $51,000 as part of the Emergency Management and Performance Grant (EMPG).

Early Childcare and Education Expenditure Request

This item is a funding request from the Archuleta County Education Center for a total of $136,200 to support two Early Childhood and Education projects:
  1. $66,200 for continued renovation of the building intended for the new childcare center.
  2. $70,000 to fund a tuition voucher program.
